It is a matter of course for us to respect your personal rights. This also applies to the handling of personal data when you visit and use this website. We therefore act in accordance with the applicable data protection law. In the following you will find out how we handle your personal data and in particular which data we process for which purposes and what rights you are entitled to.

1 – Scope

1.1 – This data protection declaration applies to the use of the websites offered by IAS MEXIS, which you can access at www.ias-instandhaltungssoftware.de (hereinafter referred to as “IAS MEXIS websites”). This data protection declaration does not apply to other websites of IAS MEXIS GmbH or to the websites of other service providers to which the IAS MEXIS websites refer by a link.

2 – Personal data

Personal data is all information that relates to an identified or identifiable natural person. The basic personal date is your name. In addition, your gender, your date of birth, your address, your profession, your e-mail address and IP address are also considered personal data. On the other hand, data with which it is impossible to determine your actual identity or at least requires considerable effort is not personal. This includes, for example, the aforementioned information if we receive it anonymously or under a pseudonym and therefore cannot assign it to a natural person.

3 – Principle of anonymity

When using the IAS MEXIS website, you remain anonymous to us as long as you do not voluntarily provide us with personal data by writing to us using our contact form or using our form for our newsletter.

4 – Provision of personal data

4.1 – For the use of the IAS MEXIS websites, the provision of personal data is neither required by law nor by contract and is also not required for the conclusion of a contract. You are not obliged to provide personal data about yourself. However, you cannot visit the IAS MEXIS website without transferring the IP address you are using.

4.2 – Contacting us via our contact form and registering for our newsletter require the provision or collection of the data described in sections 6 and 7. If you do not provide us with this data, you will not be able to use the contact form or the option to register for the newsletter.

5 – Processing of personal data

5.1 – We automatically collect and record the following data each time you visit the IAS MEXIS website:

  • Country of origin
  • Requesting domain
  • Used web browser
  • Operating system used
  • Notification of successful and unsuccessful retrieval
  • Entry and exit pages
  • Amount of data transferred
  • Date and time of the request
  • Name of the requested file
  • IP address of the requesting computer

This data is stored in log files on our web server as standard. The storage period for the IP address is one week, after which it is automatically deleted.

5.2 – Otherwise, we only process your personal data if you voluntarily provide it to us and if this is permitted by law or if you have given your consent. We use the personal data provided by you exclusively for the purposes stated in this data protection declaration or expressly agreed with you.

5.3 – We commission various service providers to support us in the provision, operation and maintenance of our IT systems, including the IAS MEXIS websites. These include, for example, hardware and software suppliers, Google Inc. (for the web analysis service Google Analytics, see section 13), hosting providers or data centers. If such service providers work for us on our behalf, they may, as recipients, have access to your personal data. However, these service providers are then also contractually obliged to comply with data protection via a so-called order processing agreement; the statutory provisions on data protection also apply to our service providers anyway.

5.4 – Your personal data will not be passed on, sold or otherwise transferred to third parties. Something else only applies if this is necessary for the processing of the notified or agreed purposes and is permitted without consent under applicable data protection law, you have expressly consented or we are legally obliged to do so. Item 5.3 remains unaffected, of course, and applies regardless of this Item 5.4.

5.5 – The personal data provided by you on the IAS MEXIS website or collected by us will not be used for automated decision-making.

6 – Contact form

6.1 – If you contact us via the contact form, you agree that your message with the contact details you have provided may be processed by us for the purpose of answering and contacting you. You can also enter a pseudonym (i.e. an invented name) as the name. Your consent and our legitimate interest in being able to contact users of the IAS MEXIS websites electronically form the legal basis for processing (Art. 6 Para. 1 lit. a and f GDPR).

6.2 – or the purpose of contacting you via the contact form, you have given the following declaration of consent: “Yes, I give my consent that my contact details entered above and my message may be processed by IAS MEXIS GmbH for the purpose of processing, contacting and answering. In this context I agree to the data protection declaration. I can revoke this consent at any time with effect for the future”.

6.3 – We will only process the data you provide via the contact form in order to process your message and to respond to you. As long as we have received your contact details, which you provide via the contact form, only for processing, contacting and answering your message, we will not use this personal data for any other purposes. Apart from cases in which we are legally obliged to do so, we will not pass on your contact details to third parties in this case.

6.4 – Six (6) months after sending the answer, we will delete the data you submitted via the contact form, unless we are legally obliged to store it for a longer period or we still need your personal data to carry out or process an existing contractual relationship. In such a case, we delete the relevant data after the statutory retention period has expired or as soon as we no longer need the data to carry out or process an existing contractual relationship.

6.5 – You can revoke your consent at any time for the future (see section 19 below for contact details). After the revocation, your contact details will be stored for as long as we are obliged to do so within the framework of the statutory retention requirements or we still need your personal data to carry out or process an existing contractual relationship.

7 – Subscription to our newsletter

7.1 – The IAS MEXIS website gives you the opportunity to subscribe to our company’s newsletter. The input mask used for this shows which personal data is transmitted to the person responsible for processing when the newsletter is ordered.

7.2 – IAS MEXIS GmbH informs its customers and business partners at regular intervals by means of a newsletter about company offers. You can only receive our company’s newsletter if (1) you have a valid email address and (2) you have registered to receive the newsletter. For legal reasons, a confirmation e-mail will be sent to the e-mail address you entered for the newsletter for the first time using the double opt-in procedure. This confirmation email is used to check whether the owner of the email address has authorized the receipt of the newsletter.

7.3 – For the purpose of subscribing to the newsletter, you have given the following declaration of consent: “Yes, I give my consent that the contact details I entered above may be processed by IAS MEXIS GmbH for the purpose of sending the newsletter. In this context I agree to the data protection declaration. I can revoke this consent at any time with effect for the future”.

7.4 – When you register for the newsletter, we also save the IP address of your computer system used at the time of registration, as well as the date and time of registration, assigned by the Internet service provider (ISP). The collection of this data is necessary in order to be able to trace the (possible) misuse of your e-mail address at a later point in time and therefore serves the legal protection of the person responsible for the processing.

7.5 – The personal data collected when registering for the newsletter will only be used to send our newsletter. Furthermore, subscribers to the newsletter could be informed by e-mail if this is necessary for the operation of the newsletter service or a relevant registration, as this could be the case in the case of changes to the newsletter offer or changes in the technical conditions. The personal data collected as part of the newsletter service will not be passed on to third parties. You can cancel your subscription to our newsletter at any time. The consent to the storage of personal data that you have given us for sending the newsletter can be revoked at any time. There is a corresponding link in every newsletter for the purpose of withdrawing consent. It is also possible to unsubscribe from the newsletter directly on the website of the person responsible for processing or to inform the person responsible for processing in another way.

8 – Newsletter tracking

8.1 – The IAS MEXIS GmbH newsletters contain so-called tracking pixels. A tracking pixel is a miniature graphic that is embedded in e-mails that are sent in HTML format to enable log file recording and log file analysis. This enables a statistical evaluation of the success or failure of online marketing campaigns to be carried out. Based on the embedded tracking pixel, IAS MEXIS GmbH can recognize whether and when you opened an e-mail and which links in the e-mail you called up.

8.2 – Such personal data collected via the tracking pixels contained in the newsletters are stored and evaluated by the person responsible for processing in order to optimize the newsletter dispatch and to better adapt the content of future newsletters to your interests. These personal data will not be passed on to third parties. You are entitled at any time to revoke the separate declaration of consent given via the double opt-in procedure. After a revocation, this personal data will be deleted by the person responsible for processing. The IAS MEXIS GmbH automatically interprets a withdrawal from the receipt of the newsletter as a revocation.

9 – Withdrawal of consent

9.1 – Within the framework of the statutory provisions, you have the option at any time to revoke your consent to the processing of your personal data for the future. To do this, please contact the office specified in Section 19 below.

9.2 – We would like to point out that the processing of your personal data, which we have carried out on the basis of your consent up to your revocation, will not be affected by the revocation and will remain lawful.

10 – Right to information, correction, deletion, restriction of processing, objection and data portability

Within the framework of the legal provisions, you have the right to receive information from us about your personal data processed by us, as well as the right to correction, deletion, restriction of processing, objection to processing and data portability. The precise conditions under which you are entitled to the aforementioned rights can be found in Art. 15 to 21 GDPR and Sections 34, 35 and 37 of the Federal Data Protection Act (BDSG). 11 – Right to complain

Within the framework of the statutory provisions, you have the right to contact the responsible supervisory authority with a complaint regarding data protection. 12 – Use of cookies

12.1 – We use so-called cookies on the IAS MEXIS websites. These are small text files that are stored on your device (PC, smartphone, tablet, etc.). Some of the cookies we use are deleted from your drive (hard drive, solid-state disk, flash memory, etc.) at the end of the browser session (so-called session cookies). 13 – Use of Google Analytics

13.1 – As described in more detail below in Sections 13.2 ff., we use the Google Analytics online service of the US company Google Inc. on the IAS MEXIS websites. 13.2 – The IAS MEXIS websites use functions of the web analysis service Google Analytics. The provider is Google Inc. 1600 Amphitheater Parkway Mountain View, CA 94043, USA. Google Analytics uses so-called “cookies”. These are text files which are saved on your computer and which enable an analysis of the use of the IAS MEXIS website by you (see also section 12). The information generated by the cookie about your use of this IAS MEXIS website is usually transferred to a Google server in the USA and stored there.

13.3 – If IP anonymization is activated, as is the case on the IAS MEXIS websites (see also section 13.6), your IP address will be truncated by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. The full IP address will only be transmitted to a Google server in the USA and truncated there in exceptional cases. On behalf of the operator of this IAS MEXIS website, Google will use this information to evaluate your use of the IAS MEXIS website, to compile reports on website activity and to provide the website operator with other services relating to website activity and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

13.5 – You can also prevent Google Analytics from collecting data that you create on the IAS MEXIS websites and that are stored in the cookie by activating the link below. An opt-out cookie is stored on your computer, which prevents the future collection of your data when you visit the IAS MEXIS websites (this does not apply, however, to other websites that you visit and other browsers that you use on the same computer): Google Analytics. 13.6 – Google Analytics has been expanded to include the code “anonymizeIP” on the IAS MEXIS website. The use of this code leads to an anonymous collection of your IP address by means of so-called IP masking. This will set the last octet of your IP address to zero. For IPv6 addresses, this affects the last 80 of the 128 bits. This still happens in the main memory before the data is written to the hard drive (see also https://support.google.com/analytics/answer/2763052).

14 – iframes and embedded content

14.1 – We use iframes (inline frames) on the IAS MEXIS websites to display embedded content from the following provider:

14.2 – The legal basis for our use of iframes is our legitimate interest in making Vimeo videos relevant to us conveniently accessible to users of the IAS MEXIS websites (Art. 6 Para. 1 lit. f GDPR).

14.3 – If you visit a website of the IAS MEXIS websites with the iframe mentioned in section 14.1 above, your browser will set up a direct link to the provider’s servers in order to transfer embedded content from there to your browser. This content is integrated into the IAS MEXIS websites via the iframe so that it is displayed as a kind of mini-website in the IAS MEXIS websites that you visit. You cannot see that you are thus surfing two websites at the same time. The Internet address of Vimeo is not displayed. You can recognize the Vimeo video by the typical blue / white player design.

14.4 – Vimeo, as the provider of the embedded content that is displayed to you via the iframe, is informed by the direct connection to your browser that you have visited the corresponding IAS MEXIS websites. If you have logged into your Vimeo user account at this point, Vimeo can assign your visit to the IAS MEXIS website to your user account even if you do not click on the embedded Vimeo video content. If you decide to click and use the content offered, Vimeo will know this. Your browser then sends further usage data to Vimeo, which can be saved and reused by this provider.

15 – Web Fonts

15.1 – Web fonts from Google, so-called Google Fonts, are used on the IAS MEXIS websites, which require your browser to download the required web fonts into its cache (i.e. cache). To do this, your browser establishes a connection to the servers of the web font provider and transmits the IP address used by your device at the time. The provider of the web font thus learns that a user is visiting our IAS MEXIS website with your IP address. If your browser does not support the web fonts used by the IAS MEXIS websites, the display is based on a standard font instead.

15.2 – The legal basis for our use of web fonts is our legitimate interest in correctly displaying texts and fonts from our website on the IAS MEXIS websites, regardless of the system you are using, in order to have a uniform, visually pleasing presentation of our IAS MEXIS websites to guarantee the accessing end devices (Art. 6 Para. 1 lit. f GDPR).

16 – Google Maps

Maps from the “Google Maps” service provided by Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA, are integrated into the IAS MEXIS website. The processed data may include, in particular, the users’ IP addresses and location data, which, however, are not collected without their consent (usually in the context of the settings of their mobile devices). 17 – Borlabs Cookie

The IAS MEXIS websites use Borlabs Cookie, which sets a technically necessary cookie (borlabs cookie) in order to save your cookie consent.
Borlabs Cookie does not process any personal data. The borlabs cookie stores the consent you gave when you entered the website. If you would like to revoke this consent, simply delete the cookie in your browser. When you re-enter / reload the website, you will be asked again for your cookie consent.

18 – IT security

We take various technical and organizational security measures to protect the integrity and confidentiality of your personal data. For this purpose, your personal data is encrypted during transmission using the so-called Secure Socket Layer technology (SSL). This means that the communication between your computer and the servers of the IAS MEXIS website takes place using a recognized encryption method, which is considered secure in the current version (currently TLS version 1.2). If your browser supports SSL, the transmission of personal data is protected by this function. In this case, most browsers will show you with a short dialog box or a graphic symbol whether the security protocol is supported.
